in plain terms.

This policy explains what www.theapexgroupfl.com collects, why, and what you can do about it. The site is operated by Anthony Cruz, PA, a Florida licensed real estate broker (licence BK3284470) of The Apex Group at eXp Realty, LLC.

You can browse this entire site without giving us anything. We only receive personal information when you choose to send it.

—The home valuation form. Property address, your name, mobile number, email address, timeline, whether you are also buying, and any notes you add. If you have used the net proceeds calculator on that page, the sale price and estimated net figures you entered are submitted with the form so we can see the numbers you were looking at.

—Text, call or email. If you use a Text, Call or Email button, your phone number or email address and the content of your message reach us directly through your own device and carrier or mail provider.

We do not ask for, and you should not send us, a Social Security number, date of birth, bank or card details, or copies of identity documents through this website.

—Server and security logs. The site is served by Cloudflare, which processes your IP address, browser user agent, the pages requested and timestamps in order to deliver the site and protect it from abuse. This is strictly necessary to operate the site and happens whether or not you accept cookies.

—Map tiles. The community map loads map imagery from OpenStreetMap. When you open that page, OpenStreetMap's servers receive your IP address as part of the ordinary request for tiles. We do not control OpenStreetMap and do not receive anything back about you.

—Fonts. Typefaces are served from this site's own domain, not from a third-party font host, so no font provider receives your IP address.

Strictly necessary storage. We store two small values in your browser's local storage. Neither identifies you.

—`acx_consent` — records whether you accepted or declined optional tracking, the version of the notice you saw, and when you chose. Without it we would have to ask you on every page. We also keep a copy of this choice on our own servers — see "Records of your consent" below.

—`acx_popup_seen` — records that you have already been shown the buying-or-selling prompt, so it is not repeated for two days.

Optional analytics and advertising. Nothing optional runs unless you press Accept. If you decline, or simply ignore the notice, no analytics or advertising tag is loaded at all — not in a paused state, not with limited data. The script is never added to the page.

Where those tags are enabled and you have accepted, they may include Google Analytics, Google Tag Manager and the Meta (Facebook) pixel. These use cookies and similar identifiers to measure how the site is used and to attribute advertising. Google and Meta act as independent controllers of the data they receive under their own policies.

You can change your choice at any time from the Privacy choices link in the footer, or by clearing this site's data in your browser.

Global Privacy Control. We honour the GPC browser signal. If your browser sends GPC, we treat it as a decline and as an opt-out of any sale or sharing of personal information.

We keep a record of consent decisions so that, if we are ever asked to demonstrate that permission was given, we can. We treat the two kinds of consent differently on purpose.

Cookie and tracking choices. When you press Accept or No we log the date and time, which choice you made, the version of the notice you saw, the page you were on, your browser's user agent, your country, and whether your browser sent a Global Privacy Control signal.

We do not store your full IP address for this. We store a truncated form — the last part of an IPv4 address is dropped, so 203.0.113.47 becomes 203.0.113.0/24 — together with a one-way salted hash. That is enough to show that consents came from genuinely distinct visitors, without us holding an address that identifies you. Someone who declines tracking should not have their exact address retained because they declined.

Consent to be contacted. When you submit the home valuation form you are giving us permission to reply by text and by phone, and United States telephone-consent law expects that permission to be evidenced properly. For that record we do keep your full IP address, alongside the date and time, the details you submitted, the page, your browser's user agent, and the exact wording of the consent notice that was displayed to you at the time.

That record exists to protect both of us: it is the evidence that you asked to be contacted, and the evidence of precisely what you were told when you did. It is stored separately from our marketing system so it survives even if that system does not.

How long we keep it. Consent records are kept for as long as they could be needed to answer a claim about whether permission was given — in practice at least four years, matching the federal limitation period for telephone-consent claims — and then deleted.

You can ask for a copy of your consent records, or ask us to delete them, using the contact details on this page. Deleting a record of consent also means we no longer have evidence you gave it, so we will confirm that is what you want before we do it.

If you text us, or give us your mobile number on a form, you are agreeing that we may reply and follow up by text and by phone about your enquiry.

Consent to receive messages is not a condition of any purchase or of any real estate service. Message and data rates may apply. Message frequency varies. Reply STOP to any message to opt out, or HELP for help. Opting out of texts does not remove you from email or from our records; ask us directly for that.

We do not sell, rent or share your phone number with third parties for their own marketing, and we do not share mobile opt-in data with third parties for marketing purposes.

—To answer you, prepare a valuation or a community shortlist, and provide real estate brokerage services.

—To register you with a builder as our represented buyer, where you have asked us to. That means giving the builder your name and contact details, which is the step that makes buyer representation available to you at no cost.

—To keep records we are required to keep as a licensed Florida brokerage.

We do not use what you send to train machine learning models, and we do not use it for automated decision-making that produces legal or similarly significant effects.

—Our customer relationship system. Enquiries submitted through the valuation form are delivered to our GoHighLevel account, which stores them so we can follow up.

—Our own consent log, held in a database operated by Cloudflare on our behalf and described under "Records of your consent" above. It is not shared with anyone.

—Our brokerage. The Apex Group at eXp Realty, LLC and eXp Realty, as the brokerage of record for any transaction.

—Builders, only where you have asked to be registered at a named community.

—Service providers who host and protect the site, and transaction professionals such as title companies, lenders and inspectors where a transaction is underway and you have asked us to work with them.

—Where the law requires it, including in response to lawful requests, and to establish or defend legal claims.

We do not sell your personal information, and we do not share it for cross-context behavioural advertising as those terms are used in United States state privacy laws.

Depending on where you live, you may have the right to know what personal information we hold about you, to get a copy of it, to correct it, to have it deleted, and to opt out of targeted advertising, sale or profiling. Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia have some or all of these rights under their state's law.

To exercise any of them, email Tony@apexagentpro.com or call (772) 888-5880 and say what you would like us to do. We will verify your identity by matching what you give us against what we hold — usually the email address or phone number you contacted us from. We will respond within the time your state's law allows, generally 45 days, and we may extend once where the law permits.

You may use an authorised agent. We will ask for proof of their authority.

We will not discriminate against you for exercising any of these rights. You will get the same service and the same terms either way.

If we ever deny a request, we will tell you why, and where your state provides one, we will tell you how to appeal.

We keep enquiry records for as long as needed to answer you and to meet Florida real estate record-keeping obligations, which generally require transaction records to be retained for at least five years. Records that never became a transaction are kept only as long as they are useful, and you can ask us to delete them sooner.

The site is served only over HTTPS with HSTS, and carries content-type, framing and referrer protections. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

This site is intended for adults in the market for real estate. It is not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we will delete it.

The site is operated from the United States and intended for people buying and selling property in Florida. If you visit from elsewhere, your information is processed in the United States, where privacy law may differ from your own.

We are pledged to the letter and spirit of United States policy for the achievement of equal housing opportunity. We do not use any information collected here to steer, exclude or treat anyone differently on the basis of race, colour, religion, sex, handicap, familial status or national origin.

We will post any change here and update the date at the top. If a change is significant, the consent notice is re-shown so you can make a fresh choice rather than inheriting an old one. This version is effective September 6, 2026.
